1. General provisions and definitions
1.1 These General Terms and Conditions (hereinafter referred to as “GTC”) apply to business relations between the Buyer and Mystery Dinner Games s.r.o<\/a>., with registered office at Jauri\u0161ova 4, Praha 140 00, ID No.: 08571872 (hereinafter referred to as “Operator” or “Seller”) concluded through the system of the electronic department store https:\/\/www.gameandthecity.com\/kosik\/.
1.2 The GTC regulate the rights and obligations of the parties to a purchase contract concluded remotely via the https:\/\/www.gameandthecity.com\/kosik\/ server between the Seller and the Buyer.
1.3 The rights and obligations of the parties to the sales contract are governed by the legal regulation of the sales contract pursuant to 89\/2012 SB.<\/p>

1.4 The Buyer shall be understood as a natural or legal person registered in the system, who has sent an electronic order processed by the trading system after self-authorisation.
1.5 Electronic order means an electronic form containing information about the buyer, a list of ordered goods from the e-commerce offer and the price of these goods, processed by the shop system or an e-mail sent to the seller’s address.
2.\u2028Order
2.1 The validity of an electronic order is subject to the true and complete completion of all the data and details required by the registration form, including telephone contact.<\/p>

2.2 All electronic orders received shall be deemed to be a draft contract and shall be deemed binding.
2.3 The purchase contract, on the basis of which the sale of goods by the Seller to the Buyer is made, is formed on the basis of a binding order confirmation in the system. An order (or part thereof) confirmed by the Seller by email shall be deemed to be binding on both parties, unless there is a breach of the terms and conditions agreed at the time of confirmation, in which case the relationship between the Customer and Mystery Dinner Games s.r.o. shall also arise
2.4 The essential terms and conditions are mainly the content of the order (exact specification of the goods and the number of goods), the price for the goods and transport, the method of delivery, the method of payment for the goods.
3.\u2028Cancellation of the order
3.1 Cancellation of an order by the Buyer The Buyer shall have the right to cancel an order without giving any reason at any time prior to its binding confirmation by the Seller. After the binding confirmation of the order only if the Seller fails to meet the agreed delivery conditions.\u2028In the event of cancellation of a confirmed order, the Buyer is obliged to pay the Seller for the damage caused by this action.\u2028The Seller shall be entitled to claim damages mainly in the case of the purchase of goods “to order”, which had to be procured at the customer’s request or in the event that demonstrable costs have already been incurred in connection with the securing of the goods. The cancellation fee may be up to 100% of the total price of the goods.<\/p>

3.2 Cancellation of the order by the Seller
The Seller reserves the right to cancel the order or part of it in the following cases:
* in the case of a COD order, the order could not be confirmed in a binding manner (incorrect phone number, unavailable, unresponsive to emails, etc.) * in the event that the Buyer has failed to take delivery of the goods in the past or has otherwise violated the terms and conditions * the goods are no longer manufactured or delivered or the price of the supplier of the goods has changed significantly. In the event that this situation arises, the seller will contact the buyer immediately in order to agree on the next course of action. If the Buyer has already paid part or all of the purchase price, the amount will be transferred back to the Buyer’s account or address within 15 calendar days.
4.\u2028Withdrawal from the contract of sale (mail order)
4.1 Withdrawal from the purchase contract by the buyer The buyer has the right to withdraw from the purchase contract within 7 working days of receipt of the goods in accordance with the Consumer Protection in Mail Order Sales Act No. 89\/2012 SB. In the event of exercising this right, the Buyer is obliged to comply with the conditions and procedure set out in point 4.2. of the GTC.<\/p>

4.2 How to proceed in the event of withdrawal from the Purchase Contract In the event of withdrawal from the Purchase Contract, the Supplier shall refund or compensate the Purchaser and the Purchaser shall reimburse the Supplier for all mutually accepted performance.\u2028If the Customer chooses to withdraw from the contract within the time limit set out in clause 4.1, the Customer shall comply with the following conditions:
* contact us (see contact) with a cancellation request, stating the order number, first and last name, date of purchase and your account number or refund address.\u2028* if the buyer has already received and accepted the goods, send them back to our address listed in the contact section under the following conditions: o the goods must be in their original undamaged packaging (with the protective film intact) o the goods must not have been used o the goods must be undamaged o the goods must be complete (including the packing slip, etc.) o send them back together with proof of purchase – invoice
If all of the above conditions for returning the goods are met, we will send you the money for the goods by bank transfer to your account no later than 14 working days after we have physically received the goods.\u2028The goods must be sent by registered post and insured, as we are not responsible for any loss en route to us.\u2028Cash on delivery will not be accepted.\u2028If any of the above conditions are not met, cancellation of the order will not be accepted and the goods will be returned at the sender’s expense.
5.\u2028Price conditions<\/p>

5.1 The price of the products represents the final price
5.2 The prices for postage and packing are set out in clause 6
5.3 The Buyer has the option to pay in the following currencies.
6.\u2028Shipping and packing
6.1 Mystery Dinner Games s.r.o. does not charge for packing.
6.2 The price of postage is inclusive of VAT and is determined from the final order amount after all discounts as follows:
6.3 No postage will be charged for personal collection.
6.4 Postage and packing costs for deliveries to the territory of the member states of the European Union or other countries are determined individually on the basis of a written agreement (by email) between the Buyer and the Seller.
7.\u2028Terms and conditions and payment option for the goods
7.1 By a one-off transfer from the account to the bank account of Mystery Dinner Games s.r.o. specified in the e-mail notification.
7.2 By payment on delivery upon receipt of the goods at the Post Office.
7.3 By cash at the company’s registered office on the basis of an invoice and a receipt.
7.4 If the price for the products delivered is not paid in full, the Seller shall have the right to suspend further deliveries of the goods until such time as the price has been paid.
8.\u2028Delivery terms
8.1 Deliveries of the object of performance (ordered goods) shall be dispatched as soon as possible, subject to the availability of the products and the Seller’s operational possibilities. The availability of the goods is indicated for each product.<\/p>

8.2 Each customer is informed of any changes in the status of the order by email. He can check the status of the order by logging in to the system.
8.3 Goods are delivered via Slovak Post to the address specified by the customer in the order. The shipment of goods always includes an invoice.
8.4 Goods are also available for personal collection at the registered office of Mystery Dinner Games s.r.o. by mutual agreement.
8.5 Title to the products shall pass to the purchaser upon acceptance and payment of the purchase price.
8.6 The goods are delivered exclusively on the territory of the Slovak Republic, the Czech Republic.
8.7 Delivery of the goods to the territory of the member states of the European Union or other countries is subject to prior agreement and mutual written agreement between the Buyer and the Seller on the price for postage and packing and any other delivery conditions.
9.\u2028Warranty conditions and Complaints Policy
9.1 This Complaints Policy applies to Goods which have been purchased from Mystery Dinner Games Ltd. and which are claimed within the warranty period of 24 months from the date of purchase of the Goods.
9.2 All goods purchased from Mystery Dinner Games s.r.o. are accompanied by an invoice (sales receipt) upon delivery to the purchaser, which also serves as a warranty document.<\/p>

9.3 Upon receipt of the goods, the Buyer is obliged to check the following:
* whether it is the product that has been ordered (if it is a product that has not been ordered, do not unpack or open the goods, otherwise it will not be possible to exchange them)\u2028* that the product is in an intact condition, i.e. that there is no obvious defect * that all its individual parts are working
The warranty does not cover defects in the goods caused by improper use, storage or damage to the goods by the buyer. The packaging and contents of the product must not be mechanically damaged (mechanical damage is defined as damage to the product which could not have been caused by normal use of the product for the purpose for which it was manufactured).
The buyer is obliged to claim the goods under the above conditions at the following address.

10.1 Mystery Dinner Games s.r.o. points out that the information provided on https:\/\/www.gameandthecity.com\/kosik\/s\u00fa is partly taken from third parties, may contain inaccuracies and may be updated without prior notice.
10.2 Mystery Dinner Games Ltd may change the products and services described on its site at any time without notice and does not warrant the factual accuracy of its content.<\/p>

10.3 Mystery Dinner Games s.r.o. shall not be liable to any other party for any direct, indirect or special damages caused by the use of information from its own or linked websites.
11.\u2028Privacy Policy
11.1 Mystery Dinner Games s.r.o. fully complies with Act No. 101\/2019 SB. on the protection of personal data in information systems. Our company respects your privacy. However, in order to offer you valuable services, we need to know some of your personal data. We protect this data from misuse and guarantee that we will never provide a third party with your contact information and details of your purchases.
11.2 By using this online shop, you consent to the collection and use of information about you and your purchases on the terms set out above. By registering as a customer, newsletter subscriber, survey participant and other forms of registration, you automatically agree that you can be informed about new products in our online shop by e-mail or telephone. If you no longer wish to receive this information, you have the option to stop receiving it at any time by following the procedure set out in each mailing.

1.4\u00a0Kupuj\u00edc\u00edm se rozum\u00ed v syst\u00e9mu zaregistrovan\u00e1 fyzick\u00e1 nebo pr\u00e1vnick\u00e1 osoba, kter\u00e1 odeslala po vlastn\u00ed autorizaci elektronickou objedn\u00e1vku, zpracovanou syst\u00e9mem obchodu.
1.5\u00a0Elektronickouobjedn\u00e1vkou se rozum\u00ed odeslan\u00fd elektronick\u00fd formul\u00e1\u0159, obsahuj\u00edc\u00edinformace o kupuj\u00edc\u00edm, seznam objednan\u00e9ho zbo\u017e\u00ed z nab\u00eddkyelektronick\u00e9ho obchodu a cenu tohoto zbo\u017e\u00ed, zpracovan\u00fd syst\u00e9memobchodu nebo e-mail odesl\u00e1n na adresu prod\u00e1vaj\u00edc\u00edho.
2.Objedn\u00e1vka
2.1\u00a0Podm\u00ednkouplatnosti elektronick\u00e9 objedn\u00e1vky je pravdiv\u00e9 a \u00fapln\u00e9 vypln\u011bn\u00edv\u0161ech, registra\u010dn\u00edm formul\u00e1\u0159em po\u017eadovan\u00fdch \u00fadaj\u016f an\u00e1le\u017eitost\u00ed, v\u010detn\u011b telefonick\u00e9ho kontaktu.
2.2\u00a0V\u0161echny p\u0159ijat\u00e9 elektronick\u00e9 objedn\u00e1vky jsou pova\u017eov\u00e1ny za n\u00e1vrh smlouvy a jsou pova\u017eov\u00e1ny za z\u00e1vazn\u00e9.
2.3 Kupn\u00ed smlouva, na jej\u00edm\u017e z\u00e1klad\u011b je realizov\u00e1n prodej zbo\u017e\u00ed prod\u00e1vaj\u00edc\u00edm kupuj\u00edc\u00edmu vznik\u00e1 na z\u00e1klad\u011b z\u00e1vazn\u00e9ho potvrzen\u00ed objedn\u00e1vky v syst\u00e9mu. Prod\u00e1vaj\u00edc\u00edm e-mailem potvrzen\u00e1 objedn\u00e1vka (nebo jej\u00ed \u010d\u00e1st) je pova\u017eov\u00e1na za z\u00e1vaznou pro ob\u011b strany, pokud nedojde k poru\u0161en\u00ed podm\u00ednek dohodnut\u00fdch v dob\u011b potvrzen\u00ed a tehdy z\u00e1rove\u0148 vznik\u00e1 vztah mezi z\u00e1kazn\u00edkem a spole\u010dnost\u00ed Mystery Dinner Games s.r.o
2.4\u00a0Zapodstatn\u00e9 podm\u00ednky se pova\u017euj\u00ed hlavn\u011b obsah objedn\u00e1vky (p\u0159esn\u00e1 specifikace zbo\u017e\u00ed a jeho po\u010det), cena za zbo\u017e\u00ed a p\u0159epravu, zp\u016fsob doru\u010den\u00ed, zp\u016fsob \u00fahrady za zbo\u017e\u00ed.<\/p>

3.Storno objedn\u00e1vky
3.1\u00a0Stornoobjedn\u00e1vky ze strany kupuj\u00edc\u00edhoKupuj\u00edc\u00ed m\u00e1 pr\u00e1vo stornovatobjedn\u00e1vku bez ud\u00e1n\u00ed d\u016fvodu kdykoli p\u0159ed jej\u00edm z\u00e1vazn\u00fdmpotvrzen\u00edm prod\u00e1vaj\u00edc\u00edm. Po z\u00e1vazn\u00e9m potvrzen\u00ed objedn\u00e1vky pouze v p\u0159\u00edpad\u011b, \u017ee prod\u00e1vaj\u00edc\u00ed nespln\u00ed dohodnut\u00e9 podm\u00ednky dod\u00e1n\u00ed. V p\u0159\u00edpad\u011b stornov\u00e1n\u00ed potvrzen\u00e9 objedn\u00e1vky je kupuj\u00edc\u00ed povinen uhradit prod\u00e1vaj\u00edc\u00edmu \u0161kodu vzniklou t\u00edmto jedn\u00e1n\u00edm. Prod\u00e1vaj\u00edc\u00ed uplatn\u00ed pr\u00e1vo na \u00fahradu \u0161kody zejm\u00e9na v p\u0159\u00edpad\u011b n\u00e1kupu zbo\u017e\u00ed \u201ena objedn\u00e1vku\u201c, kter\u00e9 bylo nutn\u00e9 na p\u0159\u00e1n\u00ed z\u00e1kazn\u00edka po\u0159\u00eddit nebo v p\u0159\u00edpad\u011b, \u017ee v souvislosti se zaji\u0161t\u011bn\u00edm zbo\u017e\u00ed do\u0161lo ji\u017e k vynalo\u017een\u00ed prokazateln\u00fdch n\u00e1klad\u016f. Storno poplatek m\u016f\u017ee b\u00fdt do v\u00fd\u0161e a\u017e 100% z celkov\u00e9 ceny zbo\u017e\u00ed.
3.2\u00a0Stornoobjedn\u00e1vky ze strany prod\u00e1vaj\u00edc\u00edho
Prod\u00e1vaj\u00edc\u00ed si vyhrazuje pr\u00e1vo zru\u0161it objedn\u00e1vku nebo jej\u00ed \u010d\u00e1st v t\u011bchto p\u0159\u00edpadech:
*v p\u0159\u00edpad\u011b objedn\u00e1vky na dob\u00edrku objedn\u00e1vku nebylo mo\u017en\u00e9 z\u00e1vazn\u011bpotvrdit (chybn\u011b uveden\u00e9 telefonn\u00ed \u010d\u00edslo, nedostupn\u00fd,neodpov\u00edd\u00e1 na e-maily atd.)* p\u0159\u00edpad\u011b, \u017ee kupuj\u00edc\u00ed si vminulosti nep\u0159evzal zbo\u017e\u00ed nebo jin\u00fdm zp\u016fsobem poru\u0161il obchodn\u00ed podm\u00ednky* zbo\u017e\u00ed se ji\u017e nevyr\u00e1b\u00ed nebo nedod\u00e1v\u00e1 nebo se v\u00fdrazn\u00fdm zp\u016fsobem zm\u011bnila cena dodavatele zbo\u017e\u00ed. V p\u0159\u00edpad\u011b, \u017ee tato situace nastane, prod\u00e1vaj\u00edc\u00ed bude okam\u017eit\u011b kontaktovat kupuj\u00edc\u00edho za \u00fa\u010delem dohody o dal\u0161\u00edm postupu. V p\u0159\u00edpad\u011b, \u017ee kupuj\u00edc\u00ed zaplatil ji\u017e \u010d\u00e1st nebo celou \u010d\u00e1stku kupn\u00ed ceny, bude mut\u00e1to \u010d\u00e1stka p\u0159evedena zp\u011bt na jeho \u00fa\u010det nebo adresu ve lh\u016ft\u011b 15-ti kalend\u00e1\u0159n\u00edch dn\u016f.
4.Odstoupen\u00ed od kupn\u00ed smlouvy (z\u00e1silkov\u00fd obchod)
4.1\u00a0Odstoupen\u00edod kupn\u00ed smlouvy ze strany kupuj\u00edc\u00edhoKupuj\u00edc\u00ed m\u00e1 pr\u00e1vo v souladu se z\u00e1konem O ochran\u011b spot\u0159ebitele u z\u00e1silkov\u00e9ho prodejce. 89\/2012 SB odstoupit od kupn\u00ed smlouvy do 7 pracovn\u00edch dn\u016f od p\u0159evzet\u00ed zbo\u017e\u00ed. V p\u0159\u00edpad\u011b uplatn\u011bn\u00ed tohoto pr\u00e1va je kupuj\u00edc\u00ed povinen dodr\u017eet podm\u00ednky a postup uveden\u00fd v bod\u011b 4.2. VOP.<\/p>

4.2\u00a0Akopostupovat v p\u0159\u00edpad\u011b odstoupen\u00ed od kupn\u00ed smlouvyVzhledem k tomu, \u017ee v p\u0159\u00edpad\u011b odstoupen\u00ed se smlouva od za\u010d\u00e1tku ru\u0161\u00ed, vr\u00e1t\u00ed nebo nahrad\u00ed dodavatel kupuj\u00edc\u00edmu a kupuj\u00edc\u00ed dodavateliv\u0161echna vz\u00e1jemn\u011b p\u0159ijat\u00e1 pln\u011bn\u00ed. Pokud se z\u00e1kazn\u00edk rozhodne pro odstoupen\u00ed od smlouvy ve lh\u016ft\u011b uveden\u00e9 v bod\u011b 4.1, je povinen dodr\u017eet n\u00e1sleduj\u00edc\u00ed podm\u00ednky:
*kontaktovat n\u00e1s (viz kontakt) s \u017e\u00e1dost\u00ed o odstoupen\u00ed od smlouvy s uveden\u00edm \u010d\u00edsla objedn\u00e1vky, jm\u00e9na a p\u0159\u00edjmen\u00ed, data n\u00e1kupu a sv\u00fdm \u010d\u00edslem \u00fa\u010dtu \u010di adresou pro vr\u00e1cen\u00ed pen\u011bz. *pokud kupuj\u00edc\u00ed ji\u017e zbo\u017e\u00ed obdr\u017eel a p\u0159evzal, za\u0161le jej zp\u011bt na na\u0161i adresu uvedenou v sekci kontakt a to za n\u00e1sleduj\u00edc\u00edch podm\u00ednek: zbo\u017e\u00ed mus\u00ed b\u00fdt v p\u016fvodn\u00edm nepo\u0161kozen\u00e9m obalu (s nepo\u0161kozenou ochrannou f\u00f3li\u00ed) o zbo\u017e\u00ed nesm\u00ed b\u00fdt pou\u017eito zbo\u017e\u00ed mus\u00ed b\u00fdt nepo\u0161kozeno zbo\u017e\u00ed mus\u00ed b\u00fdt kompletn\u00ed (v\u010detn\u011b p\u0159\u00edbalov\u00e9ho let\u00e1ku a podobn\u011b) o za\u0161lete spolu s dokladem o koupi \u2013 faktura
P\u0159ispln\u011bn\u00ed v\u0161ech v\u00fd\u0161e uveden\u00fdch podm\u00ednek pro vr\u00e1cen\u00ed zbo\u017e\u00ed V\u00e1m pen\u00edze za zbo\u017e\u00ed za\u0161leme p\u0159evodem na V\u00e1\u0161 \u00fa\u010det a to nejpozd\u011bji do 14 pracovn\u00edch dn\u016f po fyzick\u00e9m obdr\u017een\u00ed zbo\u017e\u00ed. Zbo\u017e\u00ed mus\u00ed b\u00fdt zasl\u00e1no doporu\u010den\u011b a poji\u0161t\u011bno, proto\u017ee neru\u010d\u00edme za jeho p\u0159\u00edpadnou ztr\u00e1tu na cest\u011b k n\u00e1m. Z\u00e1silky na dob\u00edrku nebudou akceptov\u00e1ny. V p\u0159\u00edpad\u011b nespln\u011bn\u00ed n\u011bkter\u00e9 z v\u00fd\u0161e uveden\u00fdch podm\u00ednek nebude akceptov\u00e1no odstoupen\u00ed od objedn\u00e1vky a zbo\u017e\u00ed bude vr\u00e1ceno na n\u00e1klady odes\u00edlaj\u00edc\u00edho zp\u011bt.
5.Cenov\u00e9 podm\u00ednky
5.1\u00a0Cenav\u00fdrobk\u016f p\u0159edstavuje kone\u010dnou cenu
